Apple bans Samsung Galaxy Tab 10.1 in the US

Apple wins latest patent dispute against Samsung

Apple has been granted its request to ban Samsung's Galaxy Tab 10.1 tablet in the US.

The iPad maker has had previous bids for injunctions on the Android tablet and Galaxy smartphones, including the Galaxy S3, denied. However, a federal appeals court instructed Judge Lucy Koh to reconsider Apple's request on the tablet, according to Reuters.

"Although Samsung has a right to compete, it does not have a right to compete unfairly, by flooding the market with infringing products," said Koh.

Koh ruled that the Galaxy Tab 10.1 infringed on a design patent held by Apple. She added that the injunction will become effective once Apple stumps a $2.6m bond to protect Samsung against damages should the injunction be found to be incorrect later.

It represents a big win for Apple in the long standing patents battle which has focused predominantly on Samsung. Apple was recently denied an injunction on Google owned Motorola devices in the US with the verdict it would harm consumers.

Samsung said: "Samsung is disappointed with the U.S. District Court for the Northern District of California’s decision. We believe today’s ruling will ultimately reduce the availability of superior technological features to consumers in the United States."

"Apple sought a preliminary injunction of Samsung's Galaxy Tab 10.1, based on a single design patent that addressed just one aspect of the product's overall design. Should Apple continue to make legal claims based on such a generic design patent, design innovation and progress in the industry could be restricted." it added

It is highly likely that Samsung will appeal against the decision and try and reverse the ban.
