Court rejects Apple Samsung tablet copy claim

Legal ding dong as Apple clashed with Samsung in Europe

A Dutch judge has cleared Samsung of “slavishly copying” the Apple iPad in the design of its popular Galaxy Tab 10.1 tablet.

The judge further ruled that Samsung doesn’t infringe on two patent claims about intellectual copyright and design.

He did, however, grant Apple a preliminary injunction banning three Samsung Galaxy smartphones in several major European countries.

At the start of August Samsung was ordered to stop selling the Galaxy Tab 10.1 in Europe after Apple obtained a temporary injunction in a German court.

Apple had claimed the Samsung tablet infringed Apple patents for theiPad and the iPhone.

"It's no coincidence that Samsung's latest products look a lot like the iPhone and iPad, from the shape of the hardware to the user interface and even the packaging. This kind of blatant copying is wrong, and we need to protect Apple's intellectual property when companies steal our ideas," Apple said during the German action.

However, the ban was lifted two weeks later.

A spokesman for the court said the ban has been lifted outside Germany as it is disputable whether a German court can halt the sales of devices outside Germany if the company’s HQ is based in South Korea.

However, the German arm of Samsung is still banned for selling the Galaxy Tab 10.1.

A further German court hearing on the Galaxy Tab injunction, embargo and ban will be held tomorrow (August 25, 2011).
