Apple Suffers Courtroom Beatdown Over 'Appstore' Trademark

A California federal judge has rejected Apple's claim that Amazon's use of the word "Appstore" to describe its Android marketplace is "confusing and misleading to customers."

The judge quite rightly noted that "there is evidence that the term 'app store' is used by other companies as a descriptive term for a place to obtain software applications for mobile devices." He also twisted the knife a bit by saying that "Apple has not established that its 'App Store' mark is famous, in the sense of being 'prominent' and 'renowned'."

Amazon countersued Apple back in April on the grounds that the term "app store" was too generic to trademark. Apple promptly countersued Amazon right back, denying that the term "app store" was, in fact, generic, and that they believed according to the definition they'd just made up that the Amazon Appstore was not an "app store." Rumors that Apple also said Amazon's dad smelled of poop are probably grossly overexaggerated.

So it looks like the Amazon Appstore is here to stay for the moment -- at least until Apple figures out what to object to next.
