Apple faces legal action over iPad 4G claim

Consumer body says Apple is breaking consumer laws and misleading punters down under

Apple is looking at legal action against a consumer agency in Australia which is hoping to take the firm to court for misleading customers about its new iPad's 4G capability. Visit iPad 4 release date, specs and rumour round-up.

The Australian Competition and Consumer Commission (ACCC) is seeking injunctions, pecuniary penalties, corrective advertising and refunds to consumers affected by the debacle. It said it wants "urgent interlocutory relief" so customers are aware of the technical capabilities of the iPad.

The ACCC said: "The ACCC alleges that Apple's recent promotion of the new "iPad with WiFi + 4G" is misleading because it represents to Australian
consumers that the product "iPad with WiFi + 4G" can, with a SIM card, connect to a 4G mobile data network in Australia, when this is not the case."

The ACCC has announced that it will be making an application for orders against Apple at the Federal Court in Melbourne tomorrow at 9.30am. It says that the tablet maker has broken Australian consumer law.

Apple's recently launched iPad is able to connect to a 4G mobile network but the frequencies it uses do not match up to those used down under.

"Consumers who have purchased or are considering purchasing an "iPad with WiFi + 4G" should ensure that they have a proper understanding of the mobile data networks which this iPad can directly access by a SIM card." added the ACCC.
