How to find out if the Carrier IQ application is on my smart phone

Hi Folks
Some of you may know that there is an application called Carrier IQ which is stored under a few 'layers' on some smart phones, which detects everything you do.
How can I find out if this is stored on my phone? If it is, then can I take any action in terms of privacy laws etc?

Thanks for your response.
I haven't tried removing it yet because I'm not very technically minded. It just seems to be a complicated process!!
Anyway, when (and if) I manage to detect the Carrier IQ on my phone, can I take any action in terms of privacy laws etc?
