win xp pro oem transfer

i have a copy on win xp pro which was supplied by dell on a pc, i also have the product key.
the machine it was supplied with is no longer in existance, plus it did not as to be activated when it was first bought, about a year ago.
now i presume dell activated the license? can i install it on my home pc, and will need to reactivate it. it is not piracy since it is the original, and it is not copyright.
basically is it legal and can anything stop me activating it.

It probably wont install,as being a Dell version it will have the drivers for the Dell machine included and be missing the drivers for a "normal" machine.

I once owned a Compaq,it came with a couple of "Restore" cd's,I cannot extract anything off them(other than the keyboard driver)

Normally XP if installed on a computer belongs to that computer, and is non-transferable.
