Spurious folders in second HDD

I am using Vista with two 500gig sata drives.

The second drive has these two folders which I did not put there:

$RECYCLE.BIN

System Volume Information.

I tried to delete the Recycle Bin but it has come straight back and the only reason I know something has changed is the Date Modified now shows today's date.

I don't want them there, are they part of Vista and is it safe to remove them?

If so : how?

They are both reading as empty but when I tried to Delete the Recycle Bin I kept getting asked if I was sure I wanted to remove a 'desktop.ini file.

You need them there they are part of Vista and would also been there if you had XP.

I hed Four drives on my XP machine and I am pretty sure (90%)that I only had One Recycle Bin and that was on my C Drive.

I am also certain that had any of my other drives had the System Volume Info. I would have noticed this too.
