Legality of opt-in/opt-out e-mail contact

When placing a check box or drop-down with a "Would you like to receive our mailshot via e-mail" or similar question, what is the legal requirement for whether the box is ticked? Does it have to left blank for the user to opt in?

you can decide which of the two to use. Remember this however - under the terms of the EU Privacy and Electronics Communication Directive, which became law in the UK in December 2003 it's an offence to send unsolicited email to a personal email address, and to be on the safe side I always offer an opt- in option for any email contact.
