Computer/Console Emulators Legal??

What is the legal position with regards to downloading computer emulators. Not current consoles/computers like the playstation, but old systems like the MSX, Atari etc.

As the games are not available and you cannot buy the systems is it ok to download the emulators and games?

Please advise..

A pc mag covered this issue a few months ago (maybe a year ago) and came to the conclusion that many games are now in the public domain to be played, but the intellectual property rights remain with their authors. It seemed to be a grey area - some games certainly may not be used on PCs.
