Can Pipex do this?

I have a letter from Pipex dated 7/8/06 stating that my 8mb upgrade will be activated within the next 7 days. I requested a MAC code and have a confirmatory e-mail dated the 9/8/07. Pipex have charged me a cancellation fee simply for requesting a MAC code. I did not receive the code until I telephoned them today. Surely my contract is still with them until I actually use the MAC code and what if I was to change my mind? The operator did say he would arrange a refund but I shall wait and see.
