...if I work from home running a small business?
(I mean from a legal point of view rather than practical)

The operating system version has nothing whatever to do with your small business.

You don't even need a computer at all.

One of my clients, a small/medium sized cosmetics company manages without computers. Their idea of high technology is an ancient FAX machine and golfball typewriters although they are moving in the right direction now and have just bought a dedicated word processor.

I know several small businesses that are running Windows 98 (No Business Version available at the time) and they have full internet access via broadband, local network and printer sharing etc etc.

As FE stated the OS has nothing to do with running a business - Linux is free and OpenOffice is more than comparible to MS Office - so you don`t need to spend a fortune on software to make it happen.
