New ssd can't install OS X

So the hdd in my MacBook Pro (a1278) died and I replaced it with a Samsung ssd 850 evo 500gb. Everything seems to be fine with the ssd disk utility says it's ok, and it's been formatted in Mac OS extended journaled. I'm using internet recovery as I have no OS discs and my hard drive died suddenly so I can't clone it. The problem is time machine won't restore it and neither will a fresh install of OS X from the Internet. It's goes through the whole process and stop just before it finishes and gives me an error and says contact software manufacturer. Any ideas? I've done the pram reset also
